This is a translation for your convenience. The German version is legally binding.
1. Scope
These terms apply to the online service Our Little Space at ourlittlespace.co, provided by Romel Estate Beteiligungs GmbH, Meinekestr. 5, 10719 Berlin, Germany ("we"). The purchase of the keychains is additionally governed by the terms of the respective sales channel.
2. Service
A set consists of keychains sharing one permanent link (QR code). The link sets up a private space for two people to share messages, memories and photos. Use of the space is included in the price of the set; there are no recurring fees.
3. Account and activation
An account with a valid email address is required. Your details must be true and your password kept secret. You must be at least 16 years old.
Whoever first activates a set's link creates the space and can invite a second person. A space has at most two members. Each account can belong to exactly one space.
If a set is given as a gift, activation belongs to the recipient. Rights to a space belong to its members, not to the person who bought the set.
4. Shared space
Both keychains of a set open the same space. Both members see all of its content.
Each member can delete their own account at any time in Settings. Their account and all content they created are deleted; the space remains with the other member's content, and the other member becomes its sole owner. The keychains keep opening this space.
Two members can delete the whole space only together. If there is only one member, they can delete it alone. After deletion the set can be activated again.
Deleted content cannot be restored. Before deleting, every member can download a copy of their data.
5. Content
Members are responsible for their own content. Only content you hold the necessary rights to may be uploaded, and no unlawful content, in particular no sexual depictions of minors, no depictions of violence and nothing that infringes the rights of others.
Members grant us only the rights needed to provide the service technically (storing, resizing photos, displaying them in the space). We do not look at content unless needed to fix an error, requested by the member, or there is a concrete indication of a legal violation.
6. Availability and support
We aim for smooth operation but cannot guarantee uninterrupted availability (e.g. maintenance or outages at our providers).
For access problems (e.g. lost access to your email address) we help via hello@ourlittlespace.co. We reset a set only if it is credibly shown that the set belongs to the requesting person, and only insofar as no rights of the other member are infringed.
Should we ever discontinue the service, we will inform members by email at least three months in advance so they can download their data.
7. Suspension
In case of serious violations of these terms or of applicable law, we may suspend an account or space after a prior warning, or immediately in the case of clearly unlawful content.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
For slight negligence we are liable only for breach of an essential contractual obligation, limited to foreseeable, typical damage. We recommend that you also keep your own copies of important photos.
9. Privacy
How we handle personal data is described in the privacy policy.
10. Changes to these terms
We may change these terms when the service or the law changes. We will inform members of changes by email at least six weeks before they take effect. Changes only apply to a member who agrees to them; without that agreement, the previous terms continue to apply to that member. The service described in section 2 will not be reduced to the members' disadvantage.
11. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of residence.
Should any provision be invalid, the remaining provisions remain in force.
